Terms and Conditions

1. Agreement
These terms govern any project undertaken by ZiaScales ("we," "us") on behalf of a client ("you"). By engaging ZiaScales for a project, you agree to these terms unless a separate written agreement explicitly overrides them.
2. Scope of work
Each project begins with a defined scope, agreed in writing (email is sufficient) before development starts. Work outside the agreed scope, additional features, revisions beyond what was discussed, or changes in direction, may incur additional cost and time, communicated and agreed before proceeding.
3. Payment
Payment terms (deposit, milestones, final payment) are agreed per project before work begins. Final source code, credentials, and deployment access are transferred upon receipt of full payment.
4. Intellectual property
Upon full payment, ownership of the final delivered code and design for your specific project transfers to you. ZiaScales retains the right to showcase completed work (screenshots, descriptions, and general outcomes) in its own portfolio and case studies, unless you request otherwise in writing.
5. Third-party services
Projects may depend on third-party services (hosting providers, payment processors, APIs, domain registrars). ZiaScales is not responsible for outages, pricing changes, or policy changes made by these third parties, though we'll help you navigate any that arise.
6. Support and maintenance
Post-launch support terms (what's included, for how long, and what happens after) are agreed per project. Ongoing maintenance beyond any included period is available separately.
7. Limitation of liability
ZiaScales will make reasonable efforts to deliver working, tested software, but does not guarantee uninterrupted or error-free operation. To the extent permitted by law, ZiaScales' liability for any claim arising from a project is limited to the amount paid for that project.
8. Cancellation
Either party may cancel an in-progress project with written notice. You will be invoiced for work completed up to the point of cancellation.
9. Governing law
These terms are governed by the laws of India. Any dispute will first be addressed through good-faith direct discussion before any formal proceedings.
